Extension of TN Admission Period Proposed by USCIS

 

On May 7, 2008 the U.S. Citizenship and Immigration Services (USCIS) released the text of a proposed rule that would extend the period of admission of Trade NAFTA (TN) non-immigrants from one year to three years. The TN classification is available to qualified Canadian and Mexican citizens who seek temporary entry into the Unites States to engage in professional employment in specific occupations.  The intention of the proposed rule is to ease administrative burdens on TN non-immigrations and their employers in US and to also make the TN classification a more workable alternative to other non-immigrant classifications (H-1B or L-1) for Canadian and Mexican citizens.

This rule is not yet final and it is unknown if and when a final rule would take effect.
