USCIS Reaches H-2B Cap for Second Half of Fiscal Year 2008

 

On January 3, 2008, the U.S. Citizen and Immigration Services (USCIS) announced they had reached the congressionally mandated H-2B cap for the second half of Fiscal Year 2008. Petitions for workers currently under the H-2B status do not count towards the H -2B cap.  The USCIS will apply a computer generated random selection process to H-2B petitions received January 2, 2008 that are subject to the cap.  Any cases not selected in the random process will be rejected and fees will also be returned.  Any H-2B cases seeking an employment start date before October 1, 2008 that arrived after January 2, 2008 will also be rejected.


The USCIS will continue to process petitions for extensions of stay of current H-2B workers in the United States, petitions that change the terms of employment and extend the stay for current H-2B workers and also petitions from current H-2B workers that need to change or add an employer and extend their stay.
